Waivers

Basic Training Waivers

Applications for waivers of constables’ basic training are allowed for those constables and deputy constables who have completed legislatively mandated basic training and are certified as municipal police officers under Act 120 by the Municipal Police Officers’ Education and Training Commission, or as deputy sheriffs under Act 2 by the Deputy Sheriffs’ Education and Training Board. A constable or deputy constable who is currently employed as a municipal police officer or a deputy sheriff may apply for a waiver of constables’ basic training, provided that his/her training and certification is current, in-force, and up-to-date upon application for waiver of constables’ basic training.

In addition, a constable or deputy constable who was formerly employed as a Pennsylvania State Police Officer, a municipal police officer, or a deputy sheriff is eligible to apply for a waiver of constables’ basic training within two years of terminating such employment. Constables and deputy constables who terminated their law enforcement employment within the last two years must have evidence that the appropriate training and certification, applicable to the level of law enforcement employment, was current, in-force, and up-to-date upon termination of that employment.

A basic training law enforcement waiver application may be obtained by calling toll-free (800) 692-7292, extension 3198. Include name, mailing address and telephone number with area code. The basic training law enforcement waiver application is also available in the constables’ training program section of the PCCD website at www.pccd.state.pa.us.

Continuing Education Waivers

There may be no waiverable subjects for municipal police officers or deputy sheriffs in a given year. Applications for partial waivers of constables’ continuing education are allowed for those constables and deputy constables who have completed legislatively mandated basic training and are certified as municipal police officers under Act 120 by the Municipal Police Officers’ Education and Training Commission, or as deputy sheriffs under Act 2 by the Deputy Sheriffs’ Education and Training Board. A constable or deputy constable who is currently employed as a municipal police officer or a deputy sheriff may apply for a partial waiver of constables’ continuing education provided that his/her training and certification is current, in-force, and up-to-date upon application for waiver of constables’ continuing education.

The Board’s policy on partial waivers of constables’ continuing education training for municipal police officers or deputy sheriffs recognizes and waives attendance for only those topics that are offered both in the municipal police officer in-service program or the deputy sheriff’s continuing education program, and the constables’ continuing education program. If there are no subjects in common among the training programs in a given year, then there are no continuing education waivers for municipal police officers or deputy sheriffs in that year.

Firearms Training Waivers

A constable or deputy constable who is currently, actively employed as a municipal police officer, a deputy sheriff, or a law enforcement officer of the Pennsylvania Game Commission or the Pennsylvania Fish and Boat Commission may apply for a waiver of the annual constables’ firearms training and certification course. The criteria for waivers of firearms training are listed below:

A currently employed municipal police officer may apply for a waiver, based upon the successful completion of the annual firearms training and certification course provided by his/her employing department, as established by the Municipal Police Officers’ Education and Training Commission (MPOETC). The officer’s MPOETC certification must be current, in-force, and up-to-date upon application for waiver.

A currently employed deputy sheriff may apply for a waiver, based upon the successful completion of the annual firearms training and certification course provided by his/her employing department. That course must meet the requirements for such firearms training established by the MPOETC. The deputy’s Deputy Sheriffs’ Education and Training Board (DSETB) certification must be current, in-force, and up-to-date upon application for waiver.

A currently employed law enforcement officer of the Pennsylvania Game Commission or Pennsylvania Fish and Boat Commission may apply for a waiver, based upon the successful completion of the annual firearms training and certification course provided by his/her employing commission, which is equivalent to the annual firearms training and certification course established by the MPOETC. A law enforcement firearms waiver application and criminal history record check form may be obtained by calling (800) 692-7292, extension 3198. Include name, mailing address and phone number with area code. Both forms are also available in the constable training program section of the PCCD website at www.pccd.state.pa.us.
